OMEGA MORPHOSIS TERMS OF USE

CHILDREN

OM wants everyone regardless of age to enjoy the benefits of our Site, services and content. Our goal is for children to creatively express themselves subject to your control as a parent or guardian. As such, we encourage parents and guardians to take an active role in their children’s use of the Site and services.

If you are under the age of 13, you must have your parent or legal guardian create their own Account (“Parent Account”) and then create a separate Account for you (“Children’s Account”). As a parent or guardian, you represent and warrant that you have reviewed and agreed to these Terms of Use and guarantee your child’s, or ward’s, as applicable, adherence to these Terms of Use. If you are under the age of 13 and your parent or legal guardian has not reviewed and agreed to these Terms of Use, then you are not permitted to access or use the Site or services and you should exit the Site and cease using the Site and services immediately until your parent or legal guardian has reviewed and agreed to these Terms of Use.

By creating a Children’s Account: (i) you provide your consent for your child, or ward, as applicable, to access and use the Site and services; (ii) you agree to be bound by these Terms in respect of your child’s, or ward’s, as applicable, access to and use of the Site and services; (iii) you hereby guarantee that your child, or ward, as applicable, shall adhere to these Terms. When registering for an Account or updating information in an Account, you agree to provide accurate age information. It is a breach of these Terms of Use to provide OM with false information, such as false age or date of birth.

For children between the ages of 13 and 18, it is a good idea to talk to and ask your parent or guardian for permission before accessing or using any of the Site or services. If you do not get such permission, you should not use the Site or services.

1.Parental Controls

We recognize that children deserve added protections with regard to their personal information, privacy and actions online. For this reason, we provide the following services for Parent Account holders (the “Parental Controls”):

(a)Child Profile Permissions: We offer Parent Account holders the ability to determine which features of the Site and services your child has access to. For example, you can limit your children’s interaction exclusively to other children.

(b)Parental Notifications: Parent Account holders can choose to receive notifications for certain actions made by their child on the Site or services. For example, you can be notified when your child adds a friend, changes Account information or creates a social media account.

We recommend that Parent Account holders familiarize themselves with all of the safety features and parental controls available on the Site or through the services.

As a Parent Account holder, you acknowledge and agree that you are solely responsible for maintaining the confidentiality of your child’s, or ward’s, as applicable, Children’s Account information and for all activities that occur under your Parent Account or any Children’s Accounts affiliated with your Parent Account. If you become aware of any unauthorized use of your Parent Account or any Child’s Accounts affiliated with your Parent Account, you are responsible for notifying OM immediately.

2.Safety

While we cannot guarantee it, we do our best to keep the Site and services safe and have designed the children’s experience of the Site and services with safety in mind. As such, you agree, on behalf of yourself and your child or ward, as applicable, that you and your child, or ward, as applicable, will use the Site and/or services in accordance with our Standards.

We proactively filter all public and comment areas of the Site and services (such as chat, forums, team walls and personal posts) to remove references to addresses, emails, phone numbers or other personal information. All text is filtered for profanity, phishing, and adult or suggestive content. Our system uses a combination of human and automated processes. However, like all filtering technology, we cannot guarantee it will be 100% effective.

3.Privacy and Data Policy

Your child’s privacy is very important to us. We include how we collect, process, use and disclose your child’s information or content your child provides in our Privacy Policy. By creating a Children’s Account and agreeing to these Terms of Use on behalf of your child, you agree that we can collect, use and share your child’s content and information in accordance with our Privacy Policy. In general, we will not use or share Account information (including personal information) from your child’s Children’s Account without your permission, except for the permissible purposes stated in our Privacy Policy.
